Status: blocked by a court order (as of 2026-10-01). D. Mass. vacated the implementing policy 2026-06-08; 1st Cir. denied a stay 2026-07-24; appeal pending. How does the H-1B wage-weighted lottery work?
Since 27 Feb 2026 each registration is entered once per wage level its offered wage reaches: Level I gets 1 entry, Level II 2, Level III 3 and Level IV 4. More entries means better odds. It applies from the FY2027 cap season onward.
What are the odds at each level?
DHS projected roughly 15% at Level I, 31% at Level II, 46% at Level III and 61% at Level IV. These are projections from the final rule, not results; real odds depend on how many people register.
How accurate is this estimate?
It compares your salary with the pay employers actually certified at each level for the same occupation in 2026 Department of Labor filings. The official level comes from the prevailing wage for the exact worksite county and occupation, so treat this as an estimate. The Department of Labor has also proposed raising the level percentiles; that rule is not final.
Does the $100,000 fee apply to me?
It only ever applied to new petitions for workers outside the US, not to change-of-status or extensions inside the US — and it is currently blocked by a court order while the government appeals.
